Reservations and Payments

To secure your reservation, we require a valid credit or debit card. Here’s a breakdown of our payment schedule:

  • Deposit: A 25% deposit of your total booking amount will be automatically charged to your card within 24 hours of making your reservation.
  • Final Payment: The remaining balance is due 45 days before your arrival date.
  • Security Deposit (optional): For private villas and some condominiums, an additional refundable security deposit and accidental damage waiver (ADW) may be required.

We’ll inform you clearly if a security deposit applies to your specific reservation.

Pricing

The cost of your stay depends on several factors:

  • Season: Prices can vary depending on the time of year you visit. Peak season (like holidays and winter months) will generally be more expensive than shoulder seasons (spring and fall).
  • Accommodation: Different room types (villas with varying numbers of bedrooms, for example) will have different nightly rates.
  • Guests: The price is typically based on a specific number of guests. There may be additional charges if you exceed this occupancy limit.

Taxes and Fees

Please note that the listed rates may not include taxes or any applicable hotel service charges. These will be added to your final bill.

Each reservation is confirmed for a specific number of guests and/or rooms. Be sure to book for the correct number of people to avoid extra fees.

Trip Confirmation

We typically send trip confirmation emails 21 days before your arrival date. However, there may be a delay if we haven’t received your final payment and any necessary forms by the due date.

Rates and Accommodation Alternatives

Note:

  • Prices, included services, and amenities may change. We will inform you of any changes.
  • In rare cases, if certain accommodations or amenities become unavailable due to unforeseen circumstances, we reserve the right to offer a comparable alternative. This also applies if a price or amenity was incorrectly displayed.
  • All prices are listed in US Dollars (USD).

Age Requirements

Minimum Age to Stay:

  • Private Villas and Condos: Many require a minimum age of 25 for all guests except children traveling with parents. Age requirements can vary, so be sure to check with the specific property you’re interested in.
  • Hotels: Minimum age requirements typically range from 21 and up, depending on the hotel.

Minimum Age to Rent a Car:

You must be at least 21 years old to rent a car in Cabo. Drivers between the ages of 21 and 24 may be subject to additional fees.

Rental Policy for Private Villas and Condominiums

Cancellations:

  • Generally, cancellation payments are non-refundable and non-transferable.
  • We will try to re-rent the property for the same dates and rate. If successful, you will receive a refund minus a 10% cancellation fee.

Rescheduling:

  • You may reschedule your reservation with at least 21 days’ notice before arrival.
  • Rescheduling applies to the same property and number of nights.
  • New travel dates must be within one year of your original check-out date.
  • A $100 rescheduling fee applies.
  • Rescheduled reservations are subject to availability and any price increases for the new dates.
  • Only one rescheduling is allowed per reservation.
  • Holiday and Limited Offer reservations cannot be rescheduled.

Security Deposit:

  • A security deposit is required to hold your reservation.
  • The amount is 25% of the total rent plus tax.
  • We will pre-authorize the deposit on your credit card (minimum $1,000) within 4 days of your arrival date. (Debit cards are not recommended).
  • Some properties or reservation types may require a cash deposit instead of pre-authorization.
  • Security deposit refunds typically take 14 days after check-out.
  • Pre-authorized deposits on credit cards usually expire after 7 days and may need to be re-authorized for longer stays.

Guest Responsibility:

During your stay, you are responsible for any damages, missing inventory, excessive cleaning charges, HOA (Homeowner Association) fines, event fees, exceeding the occupancy limit, and any service charges incurred.

Occupancy and Booking Rules

Number of Guests:

  • The maximum number of people allowed in a rental property is limited to the number booked in your reservation.
  • You must disclose the number of people in your group and the name of each person.
  • The Cabos has the right to deny entry or evict anyone not listed on your reservation. There will be additional fees for exceeding the guest limit.

Parties and Gatherings:

  • Events, parties, weddings, or other large gatherings are not allowed without written permission from The Cabos beforehand.
  • You cannot engage in activities that disturb other guests.
  • If permission is granted, there will be an additional event fee on top of the rental fee. Event fees and approval are determined by the property owner. (Event fees are typically equal to one night’s rent, but the exact amount can vary.)

Holiday Stays:

  • There is a minimum 7-night stay required for reservations between December 24th-25th and December 31st-January 1st. If booking both holidays, a 14-night minimum stay applies.

Noise Curfew:

  • Excessive noise is not permitted at any time. Quiet hours are from 10 pm to 9 am.
  • In gated communities, noise or disruptive behavior after 10 pm may result in fines.

Commercial Use:

  • Any commercial use of the property requires prior written permission from the owner and may incur additional fees.

Cancellations and Changes for Hotels and Resorts

  • If you cancel your reservation after making a deposit, The Cabos won’t charge you any additional fees. However, the specific hotel or resort you booked with might have their own cancellation policy.
  • Most hotels typically charge a fee of one night’s stay if you cancel within 72 hours of your arrival date.
  • The cancellation and change penalties can vary depending on the resort you choose and your travel dates.
  • For exact details about your reservation’s cancellation policy, refer to your invoice or contact a The Cabos specialist for further clarification.

Changes to Reservations:

A $50 fee per reservation will be applied to any adjustments made to your travel arrangements once a deposit has been secured.

Cancellations:

Reservations are non-refundable if cancelled within 14 days of arrival. A $50 per reservation fee will also apply in addition to the non-refundable amount if you cancel after placing a deposit.

Note:

Some properties and suppliers may have their own cancellation and change fees on top of ours. We recommend reviewing any additional terms directly with them.

Refund Policy

  • No refunds will be given for unused portions of reservations, services, or activities. This includes no-shows and late cancellations.
  • Restaurant reservations may have specific cancellation fees for no-shows and late cancellations. These fees will be charged to the credit card on file.
  • To request a refund, you must submit a written request within 30 days of cancellation.
  • Holiday reservations (between December 17th and January 4th) may incur a surcharge.
  • During holiday periods, cancellation penalties are doubled and may be up to 100% of the total payment.

Accidental Damage Protection (ADP)

What is ADP?

ADP is an optional protection plan available for most private villa and select condo reservations. It provides financial coverage for accidental damages that occur during your stay.

Cost of ADP:

The cost of ADP varies depending on the star rating of your chosen property:

  • 3 & 4 Star Properties: $79 per reservation
  • 5 & 6 Star Properties: $99 per reservation
  • 6+ Platinum Properties: $129 per reservation

What’s Covered?

The ADP offers a maximum benefit of up to $3,000 to cover the cost of repairing accidental damage to the property.

What’s Not Covered?

Here are some important exclusions to be aware of:

  • Damages resulting from events, parties, weddings, or other gatherings.
  • Excessive cleaning fees, such as those caused by spills or stains beyond normal wear and tear.
  • Cigarette burns or other damages caused by intentional misuse of the property.
  • Damages caused by negligence or abuse, such as leaving a window open during a storm.

Additional Notes:

  • The ADP is non-refundable.
  • The ADP is void if the maximum occupancy limit of the property is exceeded.

Unavoidable Circumstances Policy

If unforeseen events beyond our control, such as natural disasters or travel restrictions at your destination, prevent you from traveling on your planned dates, you’ll be offered some flexibility. Here’s how it works:

  • Pre-departure: If a natural disaster or travel restriction occurs at your destination before your trip, you can reschedule your booked accommodations and services to new dates within one year of your original travel dates. This applies to the same property and services you originally booked.
  • During your stay: If a natural disaster forces you to leave your destination early, you can reschedule the unused portion of your accommodations and services for new dates within one year of your original travel dates. Again, this applies to the same property and services you originally booked.

Please note that rescheduled reservations will be subject to the rates in effect at the time you rebook your accommodations or services.

Additional Charges Not Included in Rental Price

Please note: The following items are not included in the rental price and are your responsibility:

  • Airfare and transportation
  • Gratuities
  • Meals and beverages
  • Parking fees
  • Insurance (including travel insurance)
  • Resort fees and HOA fees (Homeowner Association fees)
  • Telephone charges
  • Internet access fees
  • Laundry service
  • Housekeeping (unless otherwise specified)
  • Other personal expenses

Customer Belongings

We The Cabos and any selling agent involved are not liable for lost, damaged, or delayed luggage (baggage) belonging to the customer.

Accessibility for Guests with Disabilities

Please be aware that accessibility standards in Mexico may differ from those in the United States. While we strive to be accommodating, our facilities may have limitations for guests with disabilities.

If you have specific accessibility needs, we recommend contacting us in advance of your stay to discuss potential accommodations.

Travel Documentation Requirements

Important: Please ensure you have all necessary travel documents before your trip to Mexico.

Passport:  A valid passport is required for all travelers entering Mexico. Double-check the expiration date on your passport to ensure it remains valid for the duration of your trip.

Mexican Tourist Card: U.S. citizens are typically required to obtain a Mexican Tourist Card upon arrival in Mexico.  These cards are often provided by the airline or cruise line. Confirm this detail with your carrier beforehand.

Traveling with Minors: Children under 18 years old traveling with both parents typically don’t require additional documentation. However, if a minor travels with only one parent, a notarized permission letter from the absent parent or a copy of the deceased parent’s death certificate may be necessary.  Please check with your carrier for their specific requirements for traveling minors.

Non-U.S. Citizens:  Citizens of countries other than the United States should contact the nearest Mexican Consulate  for detailed entry and visa requirements specific to their nationality.

Remember:  Following these guidelines helps ensure a smooth travel experience.  Having the proper documentation avoids delays or denied boarding at the point of departure.

Responsibility and Risk Acknowledgement

Independent Contractors:  The property owners and companies providing services like concierge, hosting, greetings, accommodations, activities, tours, and transportation for The Cabos function as independent businesses and are not directly employed by The Cabos.

Guest Responsibility:  Guests acknowledge that standards for accommodations, activities, tours, services, infrastructure, traffic regulations, transportation, hygiene (including food and water), building codes, insurance practices, healthcare, and other aspects may differ from those in the United States.

Potential Risks:  Guests may encounter various risks during their stay, including:

  • Slippery surfaces, especially when wet (floors and stairs)
  • Steep drops near some residences
  • Pools without proper fencing
  • Faulty or poorly designed electrical, plumbing, and gas systems
  • Unsafe driving conditions
  • Poorly maintained or equipped vehicles
  • Uneven or dangerous stairs and pathways

High-Risk Activities:  Certain activities offered may involve heightened risks, such as:

  • Off-road vehicles (Jeeps, Hummers, buggies, ATVs)
  • Motorcycles, scooters, and horseback riding
  • Hiking, climbing, rappelling
  • Jet skiing, jet packs, kayaking, parasailing
  • Ziplining, bungee jumping, skydiving
  • SCUBA diving, snorkeling
  • Ultralight flying, sailing, ocean cruises
  • Fishing, golfing
  • Swimming in pools or the ocean
  • Surfing

Limitation of Liability

Our Responsibility to You

We reserve the right to decline reservations at our discretion. By booking a vacation with us, you acknowledge that we are not liable for any indirect or consequential damages that may arise. Our maximum financial responsibility to you will never exceed the amount you paid for your reservation.

Guest Responsibility and Release

Each guest agrees to release us (including our employees, agents, and owners) from any legal claims, known or unknown, arising from our negligence. This includes, but is not limited to, injuries or damages caused by:

  • Our negligence related to the accommodations or activities offered.
  • Faulty inspections, supervision, instructions, or maintenance on our part.
  • Issues with vehicles, equipment, utilities, or internet service.
  • Accidents, illnesses, natural disasters, strikes, terrorism, war, theft, delays, inconveniences, construction projects, cancellations, or changes to itineraries.

In essence:

  • We reserve the right to refuse service.
  • Our financial liability is limited to your reservation cost.
  • Guests agree to release us from most claims arising from our negligence or unforeseen circumstances.

Jurisdiction and Dispute Resolution

In the event of any disagreement or claim arising from your vacation arrangements made through The Cabos, you agree that the courts of Mexico will have exclusive jurisdiction to resolve such matters.
